hi..i am recently separated from my jointly mortgaged marital home with my two teenage children.i am currently staying with my mother.i have a few queries if anyone could help..on the form for a claim for housing benefit it asks if i own a property..would the house i have a joint mortgage count as no longer live there my ex does alone also he pays the mortgage i dont..also how accurate is the online benefits calculator…my worry being, you apparantly cant claim housing benefit until a prperty is lined up for you to go to.therefore i am concerned in forking out eg.. £400 bond plus the first months rent of £400..if at the end only to be told i cannot recieve housing benefit and also is the claim backdated to the date you apply for it. i am all new to the renting buisness and have no idea how things work..just really concerned of forking out £800 and not being able to recieve housing benefit and having to leave the property as i cant afford to live there..i work 18 hours a week and recieve working and child tax credits i also recieve childbenefit…would appreciate any help anyone can give ….thank you x

if ur name is on the mortgage then u do own a house, as when ur husband sells ud b entitled to half the sale price.
the online calculator in NOT that accurate, said that my (now) x and i would get £13 pw and ended up with 35p per week in benefit.
Chidbenefit is the ONLY income not counted towards benfit entitlment, as is the 1st 10-25 of income. so depending on ur income depends how much ud get. the claim is backdated to the monday after they get the form but this may depend on ur local council
You own a home so have made yourself homeless so housing benefit would not look on an Application kindly.Why have you and the children moved out and your husband stayed there on his own?Why did you and the children not stay and he move out?This is what the benefits agency will ask.If your children haven’t left full time education and I gather they have not(child benefit) then you have a right to stay in the matrimonial home until they do leave school.At that time the home can be sold ,the profits divided between you and your husband and hopefully you will have enough for a deposit on your own home and a full time job.I would sort all this out before you go asking for any more state benefits as the DSS will certainly ask you to do.
You do have to put that you own the property as you have a joint mortgage. I’d ring HB and ask their advice as to whether you’d get any. They may look at it as though you’ve made yourself homeless and not give you anything.
if you have a house on a mortgage you don’t and never will own it until the last payment is made, the deeds are held by the building society or bank until the last penny is paid, and until they relinquish these they own the property, if you default on mortgage payments you have less rights than a tenant who doesn’t pay the rent, and will be evicted quicker.
another consideration is if the matrimonial property is in negative equity, and cannot be considered to be an asset.
are you saying you have relinquished title to the matrimonial home!!!!
normally a court would decide the apportionment of any marital property, and the ratio applicable, if you left the marital home because of a violent partner, you should make representations to the relevant specialist groups for advice, claimants advice centre is a good starting point, or the CAB.
you could require the local council to house you, especially if your mothers dwelling is overcrowded.
