I have been working for a credit card service that pays on residuals. I have worked for more that a year with this company. The company has been holding my residual checks for more that 3 months now and I don’t know where to turn. I am independant contracter for them. Is there any laws that will help me get paid for all the work I’ve done. The company keeps telling me next week I will get paid and now it’s 3 months later. I live in California the company is based in Rhode Island. Please any advise would help.

    Contact the wage and hour board and report them for holding your pay.

    You should be getting in touch with the state government in Rhode Island. Something about employee rights. This is obviously not right what is going on in your case. You can try California as well.

    Unfortunately you are an Independent Contractor and not an Employee so no labor board or state government that deals with employee rights can do anything for you.

    Since you are an IC you actually are treated like an outside vendor. I would first send them a letter stating that if you do not get your residual checks in some time period(say 14 days) you will file a suit against them for the money. Be sure to send this by certified mail with return receipt. Unless this is for over $5,000 you would then file a case in Small Claims Court. Since you are a resident of CA I believe that you can file a suit against them in CA and do not have to go to RI. The link below is all the information from CA on filing a small claims case.

    Have you been given a reason why you are having your residuals held? The business has to follow the Labor Laws of the state they are doing business in. Call the California Labor Commission and file a complaint with the Attorney Generals office.
