  1. The employer is not required to pay the credit card processing fees. So if someone leaves the tip on a credit card, the fee can be deducted.

    The fee, however, needs to be reasonable. I doubt the merchant is paying 10% to accept Visa.

    It’s against the law to charge a “customer” extra for credit card fees.

    I’m not sure about the rates at present, but they don’t charge 10%.

    15 years ago, in my business, it was 1.5- 3.5 %.
    If he just charged the fee % off your tips, that would still be less than 5%.
    Businesses charge those off as an expense of doing business. Their markup includes that expense.
    Your employer is taking it from you and still deducting as an expense.
